Last updated: August 2026

These Terms of Service ("Terms") govern your access to and use of CyberAware (the "Service"), a US-based cybersecurity awareness education platform developed as a Walsh University Honors Thesis Project by Meklit Tofu. By accessing or using the Service, or by creating an account, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

The Service is available to users aged 18 or older. By using the Service you represent that you are at least 18 years old and are able to enter into a binding agreement. The Service is not directed to, and should not be used by, anyone under 18.

2. The Service

CyberAware provides cybersecurity awareness assessments and educational content. The Service is provided for general educational and informational purposes only. It is not professional security, legal, or financial advice, and it does not guarantee protection against any security threat. You are responsible for how you apply the information.

3. Accounts

  • You are responsible for the information you provide and for keeping your login credentials confidential.
  • You are responsible for activity that occurs under your account.
  • Notify us promptly if you suspect unauthorized use of your account.
  • You may delete your account at any time from your account settings.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems.
  • Interfere with or disrupt the Service, including probing, scanning, or overloading infrastructure.
  • Copy, scrape, or redistribute the Service's content except as expressly permitted.
  • Submit false information or impersonate another person.

5. Intellectual Property

The Service, including its assessments, educational content, design, and branding, is owned by CyberAware and its creator and is protected by applicable intellectual property laws. You are granted a limited, personal, non-exclusive, non-transferable license to use the Service for your own educational purposes. Third-party content (such as embedded videos and linked resources) remains the property of its respective owners.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what we collect, why, and your rights. By using the Service you consent to the data practices described there.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that the educational content is complete or up to date.

8. Limitation of Liability

To the fullest extent permitted by law, CyberAware and its creator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from or related to your use of (or inability to use) the Service. Because the Service is provided free of charge, our total aggregate liability for any claim relating to the Service is limited to the greater of the amount you paid us (which is zero) or one hundred US dollars (US $100).

9. Third-Party Links

The Service links to and embeds third-party content. We do not control and are not responsible for third-party websites, services, or content, and linking does not imply endorsement.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

11. Governing Law

These Terms are governed by the laws of the State of Ohio, USA, without regard to its conflict-of-laws rules. You agree that any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Ohio, unless otherwise required by applicable law.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
